1. General Conditions
These Privacy Policies are part of the Terms and Conditions. It is an essential requirement that the user provide voluntary, express, and informed consent to these Privacy Policies in order to contract and carry out any transaction available on the Site.
Any inaccuracy or falsification of the personal data provided by the user may result in the suspension of services. Likewise, De Mascotas S.A. may suspend or permanently disable users who violate these Privacy Policies.
Only individuals with legal capacity to contract may operate within the Site. Parents, guardians, or legal representatives of minors or legally incapable persons who use the Site will be responsible for such use, including any charges, billing, or damages arising from it. If the user is registered as a company, they must have the authority to contract on behalf of that entity and bind it under these terms.
De Mascotas S.A. processes, collects, and in some cases discloses information about users and/or visitors of the Site. This information is collected in order to process purchases and continuously improve the experience of users and/or visitors on the Site.
De Mascotas S.A. will store personal information only for the time necessary to fulfill the purpose for which it was collected, to comply with regulatory or legal requirements, or during the legal limitation period for potential legal or contractual liabilities. Once this period has elapsed, the data will be deleted or anonymized so that no individual can be identified, in accordance with applicable regulations.
The personal information that users enter on the Site will be treated confidentially, used responsibly, and protected to safeguard privacy, taking the necessary measures to guarantee its security in accordance with the provisions of Law 25.326.
When users enter credit card data and numbers, this information is encrypted, ensuring that it remains completely confidential and cannot be viewed by other parties. This information is not stored in any database of De Mascotas S.A.
If the user registers on the Site, they accept that De Mascotas S.A. may contact them by postal mail, telephone, or electronic means to send information that, at its sole discretion, may be of interest, including advertising and information about offers and promotions.
De Mascotas S.A. does not sell or commercialize user information, nor does it share or otherwise transfer personal information to third parties, except when necessary for the following Service Providers:
- Payment methods, payment processing intermediaries, or insurance providers, in order to process payments for purchased products.
- IT system providers, cloud service providers, database providers, and technology service providers in general.
- Call centers or customer service centers.
- Companies managing loyalty or rewards programs, in order to grant benefits.
- Advertising or marketing agencies.
- Data analytics services.
- Collection agencies.
- Governmental entities or companies specialized in risk assessment, for the purpose of verifying your information.
These Service Providers only access the information strictly necessary to provide the agreed services and may not use it for purposes other than those requested.
De Mascotas S.A. complies with current regulations regarding personal data and adopts security measures in line with industry standards to protect users’ personal information. Therefore, it shall not be responsible for illegal interceptions or breaches of its systems or databases, for their use by unauthorized persons, or for the improper use of information obtained through such means.
2. User and Visitor Rights
Users have the right to exercise access, rectification, blocking, or deletion of the Personal Data they have provided to the Site, either personally or through a third party. These rights may only be exercised with respect to information that may be considered personal data under the terms of Law No. 25.326. Likewise, users may request the cancellation of their registration and the deletion of their account at any time.
To exercise any of these rights, the user must send an email to info@itsfurmates.com including their full name, ID number (DNI), their request, and the reasons for exercising their right. Once the requirements mentioned above have been met, and if the request is applicable, the user will be informed whether the request has been accepted or rejected within 5 business days from the receipt of the request.
Users are informed that, in accordance with Provision DNPDP No. 10/08, the holder of personal data has the right to access their data free of charge at intervals of no less than six months, unless a legitimate interest is demonstrated in accordance with Article 14, paragraph 3 of Law No. 25.326.
The AGENCIA DE ACCESO A LA INFORMACIÓN PÚBLICA, the supervisory authority of Law No. 25.326, is empowered to receive complaints and claims related to non-compliance with regulations on the protection of personal data.
3. Modifications to the Privacy Policy
De Mascotas S.A. reserves the right to modify the Privacy Policy in whole or in part. In such case, the modifications will be published 10 calendar days in advance so that users may review them. Users will be notified through the usual communication channels, and their consent will be requested when applicable.
4. Jurisdiction and Applicable Law
These Privacy Policies shall be interpreted and enforced in accordance with the laws of the Argentine Republic. The User irrevocably submits to the jurisdiction of the courts of the City of Buenos Aires for the resolution of any doubt, difficulty, or dispute related to all or part of these Privacy Policies.
The User shall indemnify and hold harmless De Mascotas S.A., its affiliates, parent and subsidiary companies, directors, managers, administrators, representatives, and employees, from any claim or demand by other users or third parties arising from their activities on the Site, from their breach of these Privacy Policies and any other policies incorporated herein, or from the violation of any laws or third-party rights, including legal fees, attorney’s fees, and other related costs.
For all purposes related to these Privacy Policies, De Mascotas S.A. establishes its legal address at Uruguay 590, Vicente López, Buenos Aires, Argentina.
